About The Role

The use of technology in the NHS has been fast, intense, and exciting, especially in the last year.  NHS Digital has been at the forefront of these technology and data advances, and the commercial team is a critical component of this delivery. 

We are seeking a Commercial Manager to join our team based in either our Leeds or London office. As part of our team, you will help deliver our ambition - Working together to harness the power of the marketplace to deliver maximum value to our healthcare system.  We do this to enable NHS Digital to support NHS staff at work, help people get the best care, and use the nation's health data to drive research and transform services.

You will have the opportunity to work on the management of a full range of contracts and government frameworks from smaller specialised areas to some of the biggest and most complex technology deals in the NHS.

In this role you will be responsible for the contract management lifecycle including transition to contract management, contract performance management, contract administration, contract closure and Supplier Relationship management.

In this role you will work with high-impact contracts in terms of criticality, reputational risk and value.  As these contracts are highly complex and visible, the role requires a proactive approach to help drive commercial input and assist in delivering hands on contract management to ensure value for money across the programmes.  This role has a high degree of both internal programme stakeholder and external supplier interaction to maintain the commercial baseline whilst working collaboratively with both consumers and suppliers to aid delivery.

The post holder will be required to attend meetings with supplier representatives and NHS Digital operational personnel.  Though this role will generally be internal-facing, attendance at some external-facing meetings will be required.  Engagement with supplier representatives in their specific area/s will be essential to support the day to day running of the contract. 

As a Commercial Manager you will:

  • Lead and manage multiple contracts through the contract management lifecycle, including providing contract management expertise into procurements as required
  • Ensure that all regulations, governance and contract management procedures are adhered to at all times
  • Build and manage effective relationships with stakeholder groups
  • Implement an effective contract management approach and deliver new contract management plans and processes for the contract management lifecycle
  • Assist in discussions about complex, detailed and contentious contractual issues both with suppliers and internal stakeholders
  • Assist with decisions made around highly complex questions of scope, delivery and operating models and commercial and strategic terms.
  • Develop and negotiate variations/changes to highly complex contracts with complex dependencies in a complex delivery landscape
  • Work closely with other senior and commercial, financial and procurement colleagues and wider teams to ensure a ‘joined up’ service across all programmes
  • Review contractual metrics and provide advice on commercial levers
  • Provide contract management advice to Programme and colleagues
  • Identify when legal advice is appropriate and agree with Commercial Specialist / Engagement Lead
  • Ensure value for money outcomes from contracts and performance regime
  • Identify Commercial risks and discuss with the Commercial Specialist to agree mitigation
  • Develop and implement contract compliance, apply contractual remedies, dispute resolution and ensure contingency arrangements are in place

About You

Some of the key skills and experience you'll bring to the role:  

  • Ability to understand and deal with complex problems and be able to make decisions at pace
  • A self motivated individual with the ability to act on their own initiative
  • Able to work in multidisciplined teams
  • Excellent working knowledge of the public sector contract management, supplier management, governance procedures, commercial lifecycles and complex supplier relationships
  • Excellent working knowledge of contract law, contract structures, financial models, business contingency, risk management, development of contract change notes, contract compliance, development of statements of work, serving contractual notices, applying remedies and dispute resolution.
  • Excellent oral and written communication skills
  • Strong interpersonal skills with the ability to quickly establish relationships and manage key stakeholders
  • Be customer-focused
  • Strong planning and organisational skills, able to work under pressure, prioritising workload and hitting key deadlines
  • Excellent business acumen with an ability to manage complex contracts with accuracy
  • CCM (IACCM) or equivalent professional qualification and / or evidence of equivalent level of experience
